General Terms and Conditions of Sale
These general terms and conditions define the sales conditions of the products offered by the company DEP Construction Monaco, located at 3, rue de Millo – 98000 MONACO – Phone +377 99 92 24 24 (hereinafter referred to as "Products") to Customers (hereinafter defined), on the website published by the company DEP Construction Monaco, accessible at the following address: https://depconstruction.mc/ (hereinafter the "Site").
The General Conditions may be modified by DEP Construction Monaco, with the current version being displayed in the dedicated section on the website. Each user of the Site undertakes to familiarize themselves with the latest version of the General Conditions before any use and purchase.
ARTICLE 1 – WEBSITE
The Website is published by:

The hosting of the website www.depconstruction.mc is provided by:

ARTICLE 2 – DEFINITIONS
Each time they are used in the General Conditions, the terms below shall have the following definitions:
"Customer": refers to any legal or natural person of at least 18 years of age and having the capacity to contract, who wishes to purchase the Products for their own needs;
"Order": refers to the order of Products placed by the Customer on the Site;
"Customer Account": refers to the personal account created on the Site by each Customer in accordance with the procedure described below to access the purchase of Products;
"General Conditions": refers to these general terms and conditions of use and service;
"Site": refers to the e-commerce site published by DEP Construction Monaco, 3 rue de Millo - 98 000 Monaco allowing Customers to access the purchase of Products sold by DEP Construction Monaco, and accessible from the website https://depconsruction.mc.
"Products": refers to all bio-sourced construction materials and accessories offered by DEP Construction Monaco to Customers, through the Site.
ARTICLE 4 – CUSTOMER ACCOUNT
4.1 Creation of the Customer Account
The Customer who wishes to acquire the Products on the Site must first register on the Site and create a Customer Account. To do this, they must:
• complete the form provided for this purpose and provide all the required information, including: name, first name, postal address, date of birth, email address, banking details.
• read and accept the General Conditions, by checking the box provided for this purpose.
The Customer guarantees that the information on their Customer Account is accurate and complete, and undertakes to update it in case of modification.
The creation of a Customer Account allows the Customer to generate an identifier and a password necessary to access the Site. The identifier and password are strictly personal and confidential. The Customer undertakes not to disclose them to any third party whatsoever.
Only one opening of a Customer Account per person is allowed. DEP Construction Monaco reserves the right at any time to carry out any verification it deems necessary, and to delete multiple Customer Accounts. Access to the Site through the Customer Account is strictly limited to private, personal, and non-transferable use by the Customer.

4.1 Closure of the Customer Account

The Customer may at any time close their customer account on the Site by submitting their request via email to office@depconstruction.mc

ARTICLE 5 – ORDERING PRODUCTS
​
5.1 General Terms
To use the Site and order the Products, the Customer must log in to their Customer Account from a device (phone, tablet, computer, etc.) with sufficient internet access.

5.2 Products – description and availability
The Products offered for sale on the Site are those described and whose photograph is shown on the Site. DEP Construction Monaco takes the utmost care and accuracy in the presentation and description of the items, within the limits of the technique and in accordance with the best market standards. However, errors may occur on the Site, which the Customer acknowledges and accepts. In the event of non-conformity of the product delivered compared to its description on the Site, it is the Customer's responsibility to implement the procedure provided for in the "SATISFIED OR REFUNDED" article. The Customer has the possibility to obtain additional information by contacting DEP Construction Monaco by phone at +377 99 92 24 24 or by email: office@depconstruction.mc or through the contact form on the Site. Exceptionally, in the event of total or partial unavailability of the item after placing the Order, the CUSTOMER will be informed by email of the delivery of a partial Order or the cancellation of their Order. In case of unavailability of the Product, the Customer then has the option to:
• either be delivered a Product of equivalent quality and price, subject to available stocks;
• or wait for a subsequent delivery, the deadline of which will be specified;
• or be refunded the price of the ordered Product no later than 30 days following their request.
5.3 Ordering

The Order is made after the completion of the following four successive steps:

1 - Selection of items
After clicking on the "Add to Cart" icon and checking the specifics of their Order (item, quantity, size, price, etc.) from the references of offers visible on the French version of the Site, the Customer validates the choice of the selected item(s) and their delivery method by clicking on the "PROCEED TO PAYMENT" icon.

2 - Identification
The Customer logs into their Customer Account by entering the fields provided for this purpose on the Site and indicating their username and personal password.

3 - Validation
Before validating their Order, the Customer has the opportunity to check the detail and total price of the Order and correct any errors before confirming it for acceptance. After accessing a summary, the Customer validates their Order by clicking on the "PROCEED TO PAYMENT" button. In any case, DEP Construction Monaco acknowledges receipt of the Order upon its validation by email.

4 - Payment
After confirming the contents of their Order, the Customer definitively validates it by payment.
The Order is only final upon payment of the corresponding price. The Customer is therefore debited for the amount of their purchase on the day of the Order.

The means of payment accepted to date are: Carte Bleue, VISA Card, MASTERCARD. For payment cards, the Customer provides the number of their bank card associated with its expiration date and the last three digits of the security code on the back of their bank card.
To ensure the security of payments made online, the Site uses secure payment services via SOGECOMMERCE at Société Générale. These services integrate the 3D Secure security standard. Confidential data (the 16-digit bank card number, expiration date, and security code) are directly transmitted encrypted to the SOGECOMMERCE server without passing through the physical media of the DEP Construction Monaco server.

The SOGECOMMERCE payment interface uses 3D Secure technology. This is a system developed by the two bank card networks Visa and MasterCard to authenticate cardholders and thus prevent any fraudulent use of their cards. In addition to the number, validity date, and security code, with the 3D Secure system, the cardholder must authenticate themselves on an interface of their bank to which they are automatically redirected, by entering a code or personal information that their bank will have previously transmitted to them. Once authenticated, the cardholder will see their transaction authorized or declined by their bank.

When the bank details are validated, the secure telepayment manager sends an authorization request to the bank card network. The telepayment manager issues an electronic certificate.
The Customer guarantees that they are fully authorized to use the payment card provided for the payment of their Order and that this card provides access to sufficient funds to cover all costs resulting from this Order.
In any case, the payment of the Order constitutes a signature and express acceptance of the sale at the indicated price plus shipping costs.

5 - Refusal or cancellation of Order
Failure by the Customer to comply with the obligations undertaken under these General Terms and Conditions of Sale, and in particular concerning any incident of payment of the price of an Order, may result in the suspension of access to the Customer Account and the blocking of access to new Orders on the Site. DEP Construction Monaco reserves the right to unsubscribe the Customer, (a) after having informed them at least fifteen (15) days in advance, or (b) immediately and without notice in the event of the Customer's failure to fulfill any of its obligations, in particular those provided for in the General Terms and Conditions, without prejudice to any damages and interest.

ARTICLE 6 – PRICES
The prices of the Products are expressed in Euros and include VAT at the rate in force on the day of the Order. DEP Construction Monaco reserves the right to modify them at any time. In addition to the price of the ordered items, the Customer must also pay a fixed contribution to shipping costs, the amount of which is indicated to them before the final validation of the Order.

ARTICLE 7 – DELIVERY - RECEIPT
7.1 Place of delivery
The Products will be sent to the delivery address provided by the Customer during the Order process. DEP Construction Monaco has chosen Colissimo and Chronopost for its shipments. DEP Construction Monaco delivers parcels in metropolitan France, Corsica, overseas territories, and in many foreign countries, the list of countries is indicated and validated at the time of ordering. Shipments to post office boxes are not accepted.

7.2 Delivery time
The delivery of the ordered Product(s) will take place no later than 30 days from the day following the Order, subject to the Customer's full payment of the price of the Products and the availability of the Products, unless otherwise specified to the Customer before finalizing the Order. The indicative delivery times from the date of dispatch notified to the Customer are as follows: France - Monaco: 48-72 hours with Colissimo Europe: 2 to 6 days Outside Europe: 4 to 14 days In this case, DEP Construction Monaco will provide the CUSTOMER with an estimated delivery date range. Delivery times cannot be guaranteed in case of force majeure, including strikes.

7.3 Receipt - verification
Each delivery is deemed to have been made upon delivery of the Product to the Customer, notably by the carrier, as evidenced by the control system used. The CUSTOMER will receive, upon delivery, an invoice detailing the price of each of the Product(s) and the delivery charges incurred. The CUSTOMER is expressly informed that it is their responsibility, upon delivery of the Product, to check its general condition (damage, damaged package, etc.) as well as its contents and to ensure that it conforms to their Order (designation, quantity, etc.). If this is not the case, the Customer must make their remarks or express written reservations on the delivery note. Any anomaly concerning the Products (damage, missing Product compared to the order form, damaged or opened package, broken, defective item, etc.) must be notified to DEP Construction Monaco within three (3) days following the delivery date by phone at +377 99 92 24 24 or by email at the following address: office@depconstruction.mc. It is up to the Customer to provide any justification as to the reality of the defects or anomalies observed. DEP Construction Monaco will inform the Customer of the steps to be taken, in particular concerning the return of the Product. In the event of a proven and noted defect by DEP Construction Monaco, it will, at its expense, proceed to replace the defective or damaged Product, according to its available stocks or at the Customer's choice, to its refund. If it is impossible to replace the defective Product, DEP Construction Monaco will refund the Product. Product returns and refunds will be made according to the terms provided for in 8.3.

7.4 Non-conformity
The Customer must verify that the contents of the package match their Order. If the delivered Product(s) is (are) not compliant with the Order due to DEP Construction Monaco, the Customer may, in accordance with the provisions below (ARTICLE 8) and within a period of fourteen (14) days from the receipt of the ordered Products, request a refund or exchange for the Product(s) compliant with the original Order. In case of impossibility to replace the Product(s), DEP Construction Monaco will proceed to the refund. Product returns and refunds will be made according to the terms provided for in 8.3.

ARTICLE 8 – SATISFIED OR REFUNDED – WITHDRAWAL
8.1 Withdrawal
The Customer, as a consumer, has a withdrawal period of 14 days from the receipt of the ordered Product(s), without having to justify their reasons. In this case, the Customer informs DEP Construction Monaco of their decision by means of an unambiguous written declaration, for example by returning the form below by email (office@depconstruction.mc) or by mail to the address (3, rue de Millo – 98000 MONACO):

If the above conditions are met, DEP Construction Monaco will refund the payments received from the Customer for the Order for the Products concerned. This refund will be made by crediting the Customer's bank account corresponding to the bank card used for payment within 14 days from the date of exercise of the right of withdrawal and subject to the proper return of the Product.
8.4 Return – refund
For a Customer in Metropolitan France + Corsica and Monaco, returns are free, and a return label will be sent to them by email. For other countries, the Customer must return the parcel securely and with tracking at their own expense. The Products must be returned by the Customer within 14 days following the date of notification of the withdrawal or the date of confirmation by DEP Construction Monaco of the return agreement in case of non-compliance, and under the following conditions:
• In their original packaging with labels;
• Complete (accessories, instructions, boxes);
• Clean and unused;
• Neither damaged nor deteriorated;
• Accompanied by the corresponding original invoice
• Accompanied by the duly completed return form.
Products that are not returned within the deadlines and under the conditions mentioned above will not be refunded or exchanged by DEP Construction Monaco. Upon receipt of the parcel, DEP Construction Monaco will assess the perfect condition of the returned merchandise. If the return is refused by DEP Construction Monaco, the Products will then be returned to the Customer at the expense of DEP Construction Monaco without the Customer being able to demand any compensation or right to reimbursement. ARTICLE 9 – SITE AVAILABILITY
DEP Construction Monaco strives to ensure the availability of the Site 24 hours a day, every day of the year. However, DEP Construction Monaco may, if necessary and without prior notice, suspend, interrupt, or limit access to all or part of the Site, especially for maintenance or update interventions on the Site, and various installations that contribute to its operation, or due to circumstances beyond the control of DEP Construction Monaco (identified security breach, fraudulent use of the Site, etc.). In these cases, DEP Construction Monaco cannot be held responsible for the unavailability of the Site. The Customer acknowledges and accepts the characteristics and limitations of the Internet network, particularly recognizing:
being aware of the technical hazards that may affect the Internet and mobile telephony network and cause malfunctions, anomalies, data losses, slowdowns, or unavailability making the connection slow or impossible,
being informed of the risks of data diversion circulating on the Internet. It is the Customer's responsibility in this respect to take all necessary measures to protect themselves from potential malicious software or viruses that may circulate on the Site.
ARTICLE 10 – INTELLECTUAL PROPERTY

DEP Construction Monaco is and remains the sole owner of all property rights relating to the Products and the Site. The General Conditions do not grant the Customer any ownership rights over the Site or any other rights held by DEP Construction Monaco. The Customer strictly prohibits any unauthorized use, including any copying, adaptation, creation of derivative works, distribution, reproduction, modification, translation, arrangement, dissemination, transfer, decompilation, sale, licensing, or exploitation in any other way, of the Products, the Site, or any content published on the Site, without limitation. The Customer also prohibits the reproduction of any element of the Site and the Products (ideas, features, logos, trademarks, functions, images, etc.) by any means, in any form, and on any medium.

ARTICLE 11 – PERSONAL DATA

All personal information that may be collected on the Site is subject to automated data processing. DEP Construction Monaco undertakes to collect, process, and retain all personal information of Customers in accordance with the provisions of Monegasque law No. 1.165 of December 23, 1993, and the General Data Protection Regulation (EU). The Customer is informed that they have the right to access, rectify, and delete this information. To exercise this right, they simply need to submit a request via the Internet: office@depconstruction.mc or by mail to the following address: DEP Construction Monaco, 3 rue de Millo - 98000 MONACO. The collection of this information is for the processing of Customer requests within the framework of the Site. When certain information is mandatory for the creation of the Customer Account, its mandatory nature is indicated at the time of entry. The personal data collected is intended for DEP Construction Monaco, as well as their subcontractors involved in hosting and managing the Site and/or executing Product orders (payment service providers, carriers). The Customer consents to DEP Construction Monaco's use of all data concerning them, to:
Execute the contract of sale of Products and manage Orders
Manage the Customer Account and optimize navigation on the Site;
Respond to inquiries, especially via various contact forms;
Promote and enhance the activities of DEP Construction Monaco, notably by organizing events and conferences, conducting prospecting, organizing contests, sending information/newsletters about events and new products. DEP Construction Monaco may automatically collect connection data when the Customer uses the Site:
Connection logs (login, IP address, date, and time)
Site usage information (modules, menus).
DEP Construction Monaco retains Customer data for the entire duration of the contractual relationship and as long as it is required to do so by applicable laws and the purposes defined above. When the Customer closes their Customer Account, DEP Construction Monaco may store the Customer's data in an aggregated or anonymized format. Notwithstanding the foregoing, DEP Construction Monaco may also retain Customer data as reasonably necessary to comply with its legal obligations, particularly in the event of litigation.

ARTICLE 12 - LINKS
The Customer is informed that when using the Site, a link may lead them to third-party websites not under the control of DEP Construction Monaco. DEP Construction Monaco is not responsible and cannot be held liable for the content and activities of these websites. The creation of hypertext links (simple or deep) to the Site is strictly prohibited.

ARTICLE 13 – APPLICABLE LAW - DISPUTE
​
The General Conditions, as well as the Orders, are exclusively subject to Monegasque law. In the event of a dispute, only the Courts of Monaco shall have jurisdiction. For any dispute, the Customer also has the option to use the Online Dispute Resolution platform set up by the European Union. This platform is accessible at the following link: http://ec.europa.eu/consumers/odr.

ARTICLE 14 – OTHER PROVISIONS
​
17.1 Non-waiver: It is expressly agreed that if one of the parties should refrain, temporarily or periodically, from invoking the benefit of any of the contractual provisions, such abstention shall not constitute a waiver of the application of the relevant provision(s) for the future.

17.2 Severability: Each of the provisions of the General Conditions shall apply to the fullest extent permitted by law, and the nullity in whole or in part of a clause shall have no effect on the remainder of that clause and the entirety of the General Conditions.

Return and Exchange Policy
​
Returns are free for any order in Metropolitan France and Monaco via Colissimo, within 14 days from the date of receipt of the order.
For any country outside Metropolitan France, the return or exchange of a product is at the customer's expense (return costs).
​
For a product return to be valid, it must strictly adhere to the following conditions:
return in the original packaging of all elements of the product(s) (accessories, instructions...)
clean, unused, undamaged product(s)
original invoice and product return form enclosed in the package
No refund or exchange is made for the following cases:
returned item damaged, incomplete, or soiled without being the subject of written remarks or express reservations by the user upon its withdrawal or receipt.
DEP Construction Monaco has a maximum period of 14 working days to refund or replace a product returned by the customer according to the conditions below.

METROPOLITAN FRANCE AND MONACO PROCEDURE
A free return label will be provided to you by email. You will also find a return form to fill out and include in the package. If these documents have not been provided to you, you can request them by email at office@depconstruction.mc

PROCEDURE OUTSIDE METROPOLITAN FRANCE AND MONACO
Since the return is at the customer's expense, it is advisable to return a return parcel by registered mail with acknowledgment of receipt, or by tracked Colissimo, or by any other means allowing tracking of the parcel. Attach the form indicating the reason for the return, exchange, or refund to be made.
